Swiftee User Privacy Policy

  1. Background.
    1. Swiftee is provided to You under the Swiftee User Terms of Service (“Terms”) and this Swiftee User Privacy Policy (“Privacy Policy”). All capitalized words shall have the same meaning ascribed to the them in the Terms unless otherwise mentioned herein.
    2. Swiftee and the Company understand and recognize the User’s right to confidentiality and are committed to protecting and preserving your privacy. Pursuant to such commitment, We have developed this Privacy Policy for the handling of or for dealing with User's information, as defined and provided hereunder.
    3. This Privacy Policy applies to all the Services offered under Swiftee to the User(s), and in the event that such User(s) are Minor, then their parent/lawful guardian (collectively referred to as “You” or “Your” as the context may require) unless specified otherwise. Please also read Swiftee Terms of Service, which describe the terms under which the User(s) use, and We provide Swiftee.
    4. This Privacy Policy applies to all the Services offered under Swiftee to the User(s), and in the event that such User(s) are Minor, then their parent/lawful guardian (collectively referred to as “You” or “Your” as the context may require) unless specified otherwise. Please also read Swiftee Terms of Service, which describe the terms under which the User(s) use, and We provide Swiftee.
    5. For every User, the lawful guardian/parent (as the case maybe) must be in a position to provide informed consent prior to their use of the Services and consents to Us receiving, storing, possessing, dealing with, sharing and/or handling the User's information in accordance with this Privacy Policy. Accordingly, You are required to read and understand this Privacy Policy, and the Terms.
    6. Please note that access to the Services on Swiftee is conditional upon consenting to this Privacy Policy

  2. Acceptance of Terms.
    1. By visiting, and/or using Swiftee and the associated Services thereto, You are agreeing, without limitation or qualification, to be bound by, and to comply with this Privacy Policy and all the terms thereof, and any other posted guidelines or rules applicable to any individual sections of the Application, or Services. You are requested not to use and/or access the Application and/or any part thereof if You do not approve of, agree with and accept all the terms mentioned herein.

  3. Information We Collect.
    Swiftee collects and processes personal data in connection with registration, onboarding, and use of the Application in the manner provided below:
    1. Account and Profile Information- Every User is required to provide: (a) mobile number (used for registration and OTP authentication).
    2. Interaction based data- This includes:
      • Text messages exchanged between the User and the Application.
      • Audio data generated during voice interaction sessions, including recordings where enabled.
      • Audio and video streams generated during video interaction sessions, including stored recordings where enabled.
      • Conversation transcripts.
      • Interaction metadata such as timestamps, session identifiers, duration, and platform/source information.
    3. Support Data: When a user contacts us or raises a support request via the dedicated support request form, we collect the following information from such User in order to effectively address any issue(s) which such User maybe experiencing:
      • User’s email address.
      • User’s mobile number.
      • Issue description and related communication details.
      • Timestamps and contextual information relating to support requests.
    4. System and Technical Data: We also collect device model and system related metadata associated with interactions

  4. Purpose of Processing Data.
    1. Purpose of Processing Data.
      • Creation and management of User accounts.
      • Enabling AI-based chat, voice, and video interactions.
      • Maintaining conversation continuity and contextual learning experience
      • Monitoring User and platform safety and implementing guardrails.
      • System analysis, monitoring, and improvement of AI responses and service performance.
      • Addressing support requests and resolving technical issues.
    2. It is hereby acknowledged that Swiftee processes personal data solely based on consent provided by the parent or lawful guardian of the User. Such consent is obtained at the time of registration through an in-app consent notice. Without such consent, the User cannot access or use the Application.
    3. Purpose Limitation: Personal data is processed strictly for the purposes detailed in section 4.1 above and it is hereby clarified that Swiftee does not process personal data for advertising, behavioural marketing, or profiling for commercial purposes.

  5. How We Use the Information.
    1. We use information (data) We have (subject to choices You make and applicable law) to operate, provide, improve, research, understand, and support Swiftee. Here's how:
      • Our Services: We use information We have to operate and provide Swiftee, including providing customer support; fixing, and improving the Services under Swiftee for You. We also use information We have to understand how Users use Swiftee; evaluate and improve Swiftee; undertake research and development activities; test new services and features; and conduct troubleshooting activities.
      • Safety, Security, and Integrity: Safety, security, and integrity are an integral part of Swiftee. We use information We have to combat harmful conduct, protect Users against bad experiences, and promote safety, security, and integrity on Swiftee, such as by investigating suspicious activity or violations of Our Terms and policies, and to ensure that Swiftee is being used in conformity with Our Terms.
      • We use the information You provide to enable real-time text, voice, and video interactions with Swiftee; generate contextual responses during active sessions; maintain the safety, security, and functionality of the Application; and comply with applicable legal and regulatory obligations.

  6. Data Sharing with Third Parties.
    1. Swiftee engages certain third-party service providers and technology partners to operate and support the Application. In the course of providing the Services:
      • User messages, audio inputs, and conversation context may be processed by AI technology providers to enable response generation.
      • Support requests may be processed through third-party support infrastructure.
    2. Such processing is carried out solely for the purpose of enabling and supporting the Services.

  7. Data Retention.
    1. All the data collected through Swiftee is currently retained indefinitely with no automated deletion.
    2. This retention supports:
      • Conversation continuity.
      • Monitoring system performance.
      • Safety review.
      • Improvement of AI responses and services.

  8. Data Security.
    1. Swiftee implements a combination of technical, organisational, and operational safeguards designed to protect the confidentiality, integrity, and availability of User data. These safeguards are aligned with industry-standard security practices and are intended to prevent unauthorised access, misuse, alteration, or loss of personal data.
    2. Infrastructure-Level Security: Swiftee’s data is hosted on secure, enterprise-grade cloud infrastructure providers. The architecture is designed to ensure that data is stored, transmitted, and processed in a secure environment with built-in redundancy and protection mechanisms.
    3. Media Storage (Google Cloud storage): Audio and video recordings generated from Swiftee user interactions are stored in Google Cloud storage buckets under the following safeguards:
      • All data stored in these buckets is automatically encrypted at rest using AES-256 encryption through Google-managed encryption keys.
      • Data transmitted to and from these storage systems is secured using TLS (Transport Layer Security) encryption.
      • Access to storage buckets is restricted through authenticated access controls and internal permission configurations.
    4. Relational Database Security (Amazon RDS): User profile information, messages, and system configuration data are stored in Amazon RDS databases. These databases are protected through:
      • Encryption at rest using AWS-managed encryption keys.
      • Encryption in transit using secure TLS connections for all database communications.
      • Network-level access restrictions to prevent unauthorised connections.
    5. Vector Memory Storage (Pinecone): Swiftee uses Pinecone for storing User memory embeddings and contextual interaction data required for AI functionality. Security measures include:
      • Encryption of stored data at rest within Pinecone infrastructure.
      • Encryption of all data transfers using secure TLS protocols.
      • Controlled access to memory data through authenticated service integrations
    6. Data in Transit: All data exchanged between the User’s device and Swiftee systems, as well as between internal services and third-party providers, is transmitted over secure, encrypted channels using industry-standard protocols such as TLS. This helps prevent interception, tampering, or unauthorised access during transmission.
    7. Access Control and Internal Security: Swiftee follows the principle of least privilege, ensuring that access to personal data is limited strictly to authorised personnel who require such access for operating, maintaining, or improving the Services.
    8. Content and Safety Guardrails: As an additional safety layer, Swiftee implements a moderation and guardrails framework that reviews User inputs before processing. This system helps prevent the handling of harmful, sensitive, or inappropriate content, including attempts to share personal data, thereby supporting overall data protection and platform safety. The system also restricts:
      • Content promoting harmful or illegal activities.
      • Explicit or obscene material.
      • Attempts to bypass system safeguards.
      • Requests involving sensitive personal data.
      • Academic dishonesty, inappropriate personal interactions, or non-educational use.
    9. While Swiftee implements robust safeguards, no system can guarantee absolute security. Users are encouraged to use the Application responsibly and avoid sharing sensitive personal information during interactions. Swiftee continuously reviews and updates its security practices to enhance protection in line with evolving technological and regulatory standards.

  9. User Rights.
    1. Users (through their parent or lawful guardian) have the following rights:
      • The right to withdraw consent at any time.
      • The right to request deletion of the User’s account and associated personal data.
    2. Users may request deletion of their account through the “Delete Account” feature available within the Application, following which personal data is removed from active systems and access to Swiftee is revoked.
    3. Users may withdraw their consent towards processing of their personal data by writing a mail to this effect to grievance@convegenius.ai.

  10. Third-Party Links and Services.[.
    1. Swiftee as part of its support channels also contains link to an external support form which is managed by a third-party service provider. In the event any User chooses to raise/highlight any issue by way of submitting such form, the information shared by such User shall be further governed the data handling practices of such third-party, and Swiftee does not control such third-party policies.

  11. Grievance Redressal.
    1. For any questions, concerns, or grievances regarding the Services or the processing of personal data, please contact us at: grievance@convegenius.ai. We will endeavour to address all grievances within a reasonable timeframe.

  12. Law, Our Rights and Protection.
    1. We access, preserve, and share Your information described in the “Information We collect” section of this Privacy Policy, if We have a good-faith belief that it is necessary to: (a) respond pursuant to applicable law or regulations, legal process, or government requests; (b) enforce Our Terms and any other applicable terms and policies, including for investigations of potential violations; (c) detect, investigate, prevent, or address fraud and other illegal activity or security, and technical issues; or (d) protect the rights, property, and safety of Our Users, the Application or others, including to prevent death or imminent bodily harm.

  13. Governing Law
    1. This Privacy Policy shall be governed by the laws of India, including the Digital Personal Data Protection Act, 2023 and the rules thereof.

  14. Updates to Our Privacy Policy.
    1. We may amend or update our Privacy Policy. We will provide You notice of amendments to this Privacy Policy, as appropriate, and update the last modified date at the top of this Privacy Policy. Please review Our Privacy Policy from time to time.
